WASHINGTON --Two states on Thursday gave up on the impotence drug Viagra after a federal judge said the drug maker failed to show why it was causing the deaths.

Judge Kenneth M. Schmitt in Boston ruled that the maker of Viagra, Pfizer Inc., should pay a royalty on the drug for the use of the drug in California.

Viagra, made by Eli Lilly and Co., is the world's leading impotence drug. In California, it treats erectile dysfunction, a condition that can cause impotence, in nearly 90 percent of cases.

But Pfizer said it would take Viagra to get the drug under state laws. The company had previously said it was not making Viagra available to patients in other states.

"Pfizer, when it comes to its Viagra prescription drug, is clearly not a legitimate drug," Schmitt said in a news release.

"The fact is, we have a drug that is not approved for the treatment of erectile dysfunction, and that is what makes the Viagra prescription drugs so effective."

The drug's maker has been accused of using the drug to treat impotence.

The lawsuit was filed in federal court in Philadelphia.

The suit claimed Pfizer knew of the deaths of more than 1,000 people who died due to the drug, but did nothing about the deaths in California.

"It was not part of the Pfizer's plan to prevent or treat the deaths of those people," said Michael F. Hagan, a lawyer at the University of California, Los Angeles. "It was not part of the Pfizer plan to prevent or treat the deaths of those people. We are all here for the same thing. Viagra is a drug that was designed to treat patients suffering from erectile dysfunction, and that plan is what makes Viagra so effective."

The lawsuit alleged Pfizer had improperly promoted Viagra to patients in California and failed to warn them about the drug.

Hagan said Pfizer knew of the deaths in California and that the company was not making Viagra available to patients in other states.

"Pfizer knew of the deaths of more than 1,000 people, including many who died due to the use of Viagra," Hagan said.

Viagra was sold in 50 countries and sold in 50 different states. Pfizer, the maker of Viagra, said it is not making Viagra available to patients in other states.
